Terms of Service & End User License Agreement

Welcome to Dream Sudoku. Dream Sudoku is owned and operated by TASKLUT SARL AU. These Terms of Service ("Terms", "Agreement") constitute a binding legal agreement between you ("User", "you", or "your") and TASKLUT SARL AU ("we", "us", or "our") governing your access to and use of the Dream Sudoku website located at https://www.dreamsudoku.com (the "Website") and the Dream Sudoku mobile application available on iOS and Android platforms (the "App"). This Agreement also serves as an End User License Agreement (EULA) for the mobile application.

By accessing the Website or downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of both the Website and the App.

These Terms apply to all users of the Dream Sudoku Website and App, including without limitation users who are browsers, players, contributors of content or other materials, and/or visitors to the Website or App. By using the Website or App, you represent that you are at least the age of majority in your jurisdiction or that you have obtained parental or guardian consent to use the Website and App.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

• Access and use the Dream Sudoku Website through a web browser for your personal, non-commercial entertainment purposes;
• Download, install, and use the Dream Sudoku App on a mobile device that you own or control for your personal, non-commercial entertainment purposes.

This license does not include any rights to: (a) resell or make commercial use of the Website, App, or its contents; (b) collect and use any product listings, descriptions, or prices; (c) make derivative uses of the Website, App, or its contents; (d) download or copy account information for the benefit of another party; or (e) use any data mining, robots, or similar data gathering and extraction tools. You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Dream Sudoku without express written consent.

All content, features, and functionality of the Dream Sudoku Website and App, including but not limited to all information, software, text, displays, images, video, audio, the design and arrangement thereof, the unique Sudoku game design, the proprietary Sudoku grids and number layouts, puzzle algorithms, user interface design, the Dream Sudoku logo and app icon, themes (including Neon City, US Old West, Space, Sky, Nature, Sakura, and Winter themes), and all associated intellectual property rights, are owned by TASKLUT SARL AU, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You acknowledge that the Website and App contain proprietary and confidential information that is protected by applicable intellectual property and other laws. Except as expressly authorized by us in writing, you agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Website, App, or any content therein, in whole or in part.

You agree that you will not engage in any of the following prohibited activities:

• Using any automated system, including without limitation "robots," "spiders," "offline readers," or "bots" to access or scrape the Website or App content;
• Attempting to decipher, decompile, disassemble, or reverse engineer any of the software or algorithms comprising or in any way making up a part of the Website or App;
• Using any automated bots, artificial intelligence systems, or automated scripts to play the game, solve puzzles, or interact with the Website or App;
• Attempting to bypass, circumvent, or disable any security features or technological measures implemented to protect the Website, App, or content;
• Copying, reproducing, distributing, or creating derivative works from any Sudoku grids, number layouts, puzzles, or other proprietary game content;
• Using the Website or App for any illegal purpose or in violation of any local, state, national, or international law;
• Harassing, abusing, insulting, harming, defaming, slandering, disparaging, intimidating, or discriminating based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
• Attempting to impersonate or misrepresent your affiliation with any person or entity;
• Interfering with or disrupting the Website, App, or servers or networks connected to the Website or App.

We reserve the right to terminate your access to the Website and App for violating any of these prohibited uses.

The Website and App may contain links to third-party websites, services, or resources, including links to our Privacy Policy, social media pages, or external advertising partners. These links are provided for your convenience only. We have no control over the content, privacy policies, or practices of any third-party websites or services and assume no responsibility for them. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such third-party websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit or interact with.

THE DREAM SUDOKU WEBSITE AND APP ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

• The Website or App will be available at all times or be uninterrupted, timely, secure, or error-free;
• The results that may be obtained from the use of the Website or App will be accurate or reliable;
• The quality of any products, services, information, or other material purchased or obtained by you through the Website or App will meet your expectations;
• Any errors in the Website or App will be corrected.

You understand and agree that we reserve the right to take the Website or App offline for maintenance, updates, or any other reason at any time without prior notice. Any material downloaded or otherwise obtained through the use of the Website or App is accessed at your own discretion and risk, and you will be solely responsible for any damage to your computer system or mobile device or loss of data that results from the download or use of any such material.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TASKLUT SARL AU, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Website or App;
• Any conduct or content of any third party on the Website or App;
• Any content obtained from the Website or App;
• Unauthorized access, use, or alteration of your transmissions or content;
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Website or App by any third party;
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Website or App.

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, EVEN IF A LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

We reserve the right, at our sole discretion, to modify, update, or discontinue the Website, App, or any features or functionality thereof at any time without notice or liability to you. This includes but is not limited to:

• Adding, removing, or modifying game themes, difficulty levels, or puzzle content;
• Changing the user interface, design, or layout of the Website or App;
• Updating software, algorithms, or technical features;
• Implementing new features or removing existing features;
• Making changes to pricing or monetization models (if applicable).

We may also release updates, patches, or new versions of the App from time to time. You may be required to install these updates to continue using the App. Depending on your device settings, we may automatically update the App on your device when a new version or feature becomes available. You agree that we have no obligation to provide any updates or to continue providing or enabling any particular features or functionality.

We reserve the right to modify these Terms at any time at our sole discretion. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date at the top of these Terms. You are advised to review these Terms periodically for any changes. Changes to these Terms are effective when they are posted on this page.

Your continued use of the Website or App after any such modifications constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Website and App and uninstall the App from your device.

We may terminate or suspend your access to the Website and App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Website and App will immediately cease. If you wish to terminate this Agreement, you may simply discontinue using the Website and uninstall the App from your device.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You agree to defend, indemnify, and hold harmless TASKLUT SARL AU and its licensors, affiliates, contractors, directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Website or App; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your use of the Website or App caused damage to a third party.

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which TASKLUT SARL AU is registered, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

These Terms, together with our Privacy Policy and any other legal notices published by us on the Website or in the App, shall constitute the entire agreement between you and TASKLUT SARL AU concerning the Website and App. If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.
